Q: Does the 2010 poster contain mandatory changes?

A: Yes, the Equal Employment Opportunity poster, which was amended in November 2009, includes the GINA law and is a mandatory change for 2010.

Q: Does the 2010 poster contain any recommended changes?

A: Yes, The Safety and Health (Cal/OSHA) the federal minimum wage posters are also revised.

Q: What do I need to know about the federal minimum wage increase?

A: The president signed a war spending bill and budget on May 25, 2007 that includes an increase in the federal minimum wage. Minimum wage went up to $7.25 per hour on July 24, 2009.
All California employers must post both the federal and state minimum wage posters, which are included in the CalBizCentral ">all-in-one poster. However, California employers must pay no less than the California minimum wage, which is higher than the federal rate at $8.00 per hour.

Q: Does my company need new pamphlets for 2010?

A: The 2010 workers' compensation pamphlet has updated rates relating to temporary disability payments. In 2009 the EDD's State Disability Insurance Pamphlet, and the Unemployment Insurance Pamphlet were updated.

Q: Which postings does CalBizCentral's California Employment Notices Poster include?

Q: Where should I display the poster?

A: You should display the poster anywhere that all employees can easily read it, such as a break room, common hallway, payroll office or other common location. In addition, you must display several of the posters (polygraph protection, and state and federal antidiscrimination posters) where job applicants can read them. Also, you must post the poster in each company location. The CalBizCentral poster measures 26 x 39.75 and should fit easily in many locations.


Q: What notices must be distributed to employees?

A: Required notices include:

  1. For Your Benefit (DE 2320). This pamphlet explains California's Unemployment Insurance and Disability Insurance programs and must be distributed when an employer discharges or lays off an employee, or places an employee on a leave of absence.
  2. State Disability Insurance Provisions (DE 2515). This pamphlet explains an employee's disability insurance rights and must be distributed to all new hires and again if an employee goes out on disability leave.
  3. Workers' Compensation Rights and Benefits Pamphlets. Give all new employees the Workers' Compensation pamphlet at time of hire.
  4. Sexual Harassment Pamphlet. Every California employee and independent contractor must receive a sexual harassment information sheet from his/her employer.
  5. Paid Family Leave pamphlets. This pamphlet explains California's new Paid Family Leave program. Give it to new employees and employees requesting time off for a covered reason.
  6. Earned Income Tax Credit Notification. As of January 1, 2008, all employers are required to notify all of their employees of the federal Earned Income Tax Credit (EITC).
  7. Notice to Employees (DE 35). This notice informs employees that their employer is required to send copies of Employee's Withholding Allowance Certificate (Form W-4 [federal] or DE 4 [state]) to the Franchise Tax Board (FTB) if the certificate meets certain conditions.

Q: Must I post the Cal/OSHA Log 300?

A: If you are an employer in a high-hazard industry and you employ more than 10 people, you may be required to post the Cal/OSHA Log 300. See Log 300 Recordkeeping Obligations for more information.

Q: Must I post both state and federal minimum wage posters even though California's minimum wage is higher than the federal rate?

A: Yes. California employers must post both minimum wage notices. The CalBizCentral's California Employment Notices Poster contains both. The federal minimum wage poster was updated in July 2008, and the new notice must be posted by all employers.

Q: Must I use laminated posters?

A: No. You may choose to use a laminated poster because of your work environment's needs. For example, if your company operates in a hazardous environment, outdoors or belongs to industries such as restaurants or construction, laminated posters are highly recommended.
