This EPL has available coverage limits of $500,000, $1,000,000 and $2,000,000. CalChamber members please call (800) 649-4921 to learn how to qualify for this program. Program highlights include:
- Broad coverage language for employment-related claims such as discrimination, harassment, wrongful termination, hostile work environment, failure to hire or promote, wrongful demotion, negligent evaluation, deprivation of career opportunity, retaliation, wrongful discipline, etc.
- Insures the entity as well as all employees, including part-time, temporary, leased, seasonal and independent contractors who work exclusively for the insured.
- Third Party coverage automatically included
- Wage and Hour coverage up to $250,000 for defense and indemnity automatically included
- Serious and Willful Misconduct Defense Cost Sublimit automatically included up to $100,000
- Illegal Alien Investigation Defense Costs included up to $100,000
- Coverage includes Improper disclosure of confidential employee Information resulting in identity theft.
- Full prior acts coverage is included; excluding prior knowledge and any pending and/or prior litigation (Carrier can match expiring dates if there is current EPL coverage)
- No intentional acts, downsizing, dishonesty, fraud or violation of law exclusions
- Punitive damages coverage where insurable by law with most favorable venue wording
- Worldwide territory for acts committed and suits brought in the U.S. anywhere in the world
- Contains a "Duty to Defend" provision
- Is on a "Pay on Behalf" basis
Qualifications:
- Must have a minimum of three full-time employees and no more than 75. Part-time employees are calculated as 1/2 employee and seasonal/temporary as 1/3 employee.
- Must not have experienced an employment-related claims/incidents, whether insured or not (excluding workers' compensation claims), or been named as a defendant or respondent before any Federal, State or local EEO agency.
- Must not have reduced staff or terminated more than 25 percent of the total employee count (excluding seasonal employees) in the last 24 months.
- Must not have terminated any senior management within the last 12 months.
- Must comply with all mandatory postings as required by federal and state laws.
- Coverage cannot be bound under the terms and conditions of this program for Applicants that do not fall within the program qualifications; however, Applicants will be considered for coverage outside the program.
- Employer must have an employee handbook in place.
- Employer must be in compliance with all mandatory posting requirements.
