COBRA
The Consolidated Omnibus Budget Reconciliation Act (COBRA) requires a covered group health plan to offer an opportunity to continue health plan coverage who would otherwise lose coverage as a result of a qualifying event, such as termination.

Unemployment Insurance
The Unemployment Insurance (UI) system is a federal/state program. The cost of the program in California is financed by employers through state and federal UI taxes.

San Francisco Health Assurance Plan
Adopted in February, 2006, the San Francisco Health Assurance Plan (SF HAP) was created to provide access to health care for San Francisco's uninsured adults.

Retaliation
Both federal and state law protect employees and applicants from employer retaliation for engaging in activity protected by anti-discrimination law.

Update: New Workers' Comp Posting Requirements

(9/2/2010) - California's Division of Workers' Compensation (DWC) has finalized regulations that require all employers within the state to post a new Notice to Employees - Injuries Caused by Work. You must post this notice, in a conspicuous location frequented by employees, by October 8, 2010.

No Getting Around Noncompetition Agreements

(9/2/2010) - A case out of the second appellate district highlights just how strong California's public policy is against noncompetition agreements.

FMLA now
provides additional leave rights to military personnel and their families. The federal Department of Labor (DOL) has provided an additional posting to address the recent changes in the federal law.

What's New in HR Law

New Form I-9
The U.S. Citizenship and Immigration Service issued a new Form I-9 Aug. 7; however, the previous edition of the form is still usable. We recommend using the most current form, which has an expiration date of 8/31/12.
