COBRA
The Consolidated Omnibus Budget Reconciliation Act (COBRA) requires a covered group health plan to offer an opportunity to continue health plan coverage who would otherwise lose coverage as a result of a qualifying event, such as termination.

Unemployment Insurance

Recent Legal Updates

Kin Care Does Not Apply for Uncapped Sick Leave Policies

(3/4/2010) - The California Supreme Court ruled in favor of the employer in the closely watched "kin care" case of McCarther v. Pacific Telesis Group. The employer offered an "uncapped" sick leave policy, and the issue at hand was whether such a policy qualified as "sick leave" pursuant to California's kin care law.

Arbitration Agreement Upheld in Wrongful Termination Case

(3/4/2010) - An attorney subject to an arbitration agreement sued his employer for wrongful termination. In court, the attorney fought the arbitration agreement, claiming it was unconscionable. The trial court agreed, but the Second District Court of Appeal overturned the lower court's decision and upheld the arbitration agreement.

What's New

New Form I-9
The U.S. Citizenship and Immigration Service issued a new Form I-9 Aug. 7; however, the previous edition of the form is still usable. We recommend using the most current form, which has an expiration date of 8/31/12.
